Quick Overview

The 3 Essential Steps in India

Every official name change requires statutory compliance across three distinct stages:

  • 1. Notarized Affidavit: Declaring old name, proposed new name, parentage, address, and reason on non-judicial stamp paper.
  • 2. Newspaper Publication: Publishing public notices in one English national daily and one regional language daily.
  • 3. Central Gazette Notification: Submitting application proforma, CD, and Bharatkosh fee to the Department of Publication.

Legal Significance

Why Is a Gazette of India Notification Indispensable?

While an affidavit and newspaper publication serve as public declarations, major statutory authorities in India require conclusive legal evidence before amending their records.

The Gazette of India (published under the authority of the Ministry of Housing & Urban Affairs) is the definitive government publication recognized across all Indian departments and international embassies.

  • ✓
Passport Re-issue (Major Name Change): Regional Passport Offices mandate a Gazette notification under MEA Passport Rules for any major name modification.
  • ✓
Government & Banking Services: Central & State Government employers, PSU banks, and EPFO require Gazette proof before updating service books and payroll.
  • ✓
Educational Certificates: CBSE, universities, and state examination boards require official Gazette publication to correct or alter names on degrees and marksheets.

Crucial Distinction: Correction vs Complete Name Change

Not every case requires full Gazette notification. Understanding the legal difference saves weeks of unnecessary paperwork and expenditure.

Spelling & Clerical Correction

Minor typographic typos (e.g., 'Suman' vs 'Sumana') where educational records already hold the correct spelling can often be resolved departmentally with a clarification affidavit.

Complete Legal Name Change

Adopting an entirely new first name, altering religious identity, or adding/removing a surname requires the full three-step statutory procedure including Gazette publication.

Common Questions

Frequently Asked Questions

Clear answers to the most common procedural questions regarding name changes and Gazette notifications in India.

After your complete dossier (affidavit, newspaper clippings, proforma, CD, and Bharatkosh receipt) is physically received and accepted by the Department of Publication in Civil Lines, Delhi, publication in Part IV of the weekly Saturday Gazette typically takes between 3 to 6 weeks, depending on departmental volume.

Please note: No private agency or agent can guarantee an expedited government timeline. Processing strictly depends on departmental scrutiny and queue.

While the non-tax government publication fee is paid online through the official Bharatkosh portal (bharatkosh.gov.in), the actual physical dossier containing the original stamped affidavit, original newspaper cuttings, typed proforma, CD, and photographs must be submitted either in person at the Department of Publication counter (Civil Lines, Delhi) or dispatched via Registered Post / Speed Post.

According to Department of Publication guidelines, the name-change notice must appear in two daily newspapers:

  • One prominent daily newspaper in the English language (e.g., The Indian Express, Times of India, Hindustan Times, Pioneer, etc.).
  • One prominent daily newspaper in the regional/vernacular language circulating in the applicant's residential district (e.g., Navbharat Times, Dainik Jagran, Amar Ujala, etc.).

You must preserve original full newspaper pages containing the advertisement, not just cut-out snippets.

Both Central and State Gazettes are recognized by law. However, the Central Gazette (Gazette of India) is overwhelmingly preferred because it holds universal, nationwide validity across all Central Government ministries, Regional Passport Offices across India, the armed forces, nationalized banks, and foreign consulates. Some state departments or private employers may request additional verification if a regional state gazette is used outside its home state.
